TERMS & CONDITIONS

SERVICES

These Terms & Conditions apply to all bookings, purchases, and activities provided by Fluid Flow. By making a booking, purchasing equipment, or participating in an activity, you agree to the terms outlined below.

 

1. BOOKINGS & PAYMENTS Individual Bookings Full payment is required at the time of booking for all courses, training sessions, and activities booked online. Bookings are only confirmed once payment has been received. Booking confirmations may be issued via email, SMS, or WhatsApp. Group Bookings For group bookings, a 50% deposit is required at least 14 days prior to the activity date to secure the booking. The remaining 50% balance is payable on the day of the activity, unless otherwise agreed in writing. Group bookings are only considered confirmed once the deposit has been received. If the deposit is not received within the required timeframe, Fluid Flow reserves the right to release the booking slot. Final group numbers must be confirmed 7 days prior to the booking date.

 

2. TRIP DEPOSITS For trips, expeditions, or events that require advance organisation, a deposit may be required to secure a place. All trip deposits are non-refundable, as they represent a commitment to attend and cover the administrative time, planning, staffing, and logistical organisation required in advance of the event. Once a deposit has been paid, the participant’s place is reserved and the booking is considered confirmed. 

 

3. CANCELLATION POLICY Customer Cancellations If a participant cancels their booking: • More than 14 days before the activity – booking may be transferred to another available date where possible. • 7–14 days before the activity – transfer may be offered subject to availability, but no refund will be issued. • Less than 7 days before the activity – no refund or transfer can be offered. • Failure to attend (“no show”) – the full booking fee will be forfeited. Trip deposits and booking payments are non-refundable. Participants may transfer their booking to another person if they cannot attend, provided the replacement participant meets all course requirements. Group Booking Cancellations For group bookings: • Deposits are non-refundable once paid. • If a group cancels within 14 days of the activity, the full booking fee may still be payable as staff and resources will already have been allocated. Changes to participant numbers must be communicated at least 7 days prior to the booking date.

 

4. WEATHER & CONDITIONS Adventure activities are weather and water-level dependent. Fluid Flow reserves the right to cancel, modify, or relocate activities if conditions are considered unsafe or unsuitable. If Fluid Flow cancels an activity due to: • Unsafe weather • Unsuitable river conditions • Instructor safety concerns • Insufficient participant numbers Participants will be offered: • An alternative date, or • An alternative activity where possible Refunds are not normally issued for weather-related cancellations where an alternative arrangement is available.

 

5. PARTICIPATION REQUIREMENTS All customers wishing to take part in water sports must be able to swim. Participants acknowledge that: • Outdoor adventure activities involve inherent risks • A basic level of fitness is required • Participation is undertaken at the participant’s own risk Participants are responsible for informing Fluid Flow of any relevant illness, injury, or medical condition prior to the activity.

 

6. SAFETY REGULATIONS All participants must comply with safety regulations and agree: • To wear appropriate safety clothing, headgear, and footwear • To follow all instructor instructions • Not to participate while under the influence of alcohol or drugs Failure to follow safety instructions may result in removal from the activity without refund. 

 

7. INSTRUCTOR AUTHORITY All activities are led by qualified instructors. The instructor’s decision is final in all matters relating to safety and participation. Fluid Flow instructors reserve the right to: • Refuse participation to individuals deemed unsuitably equipped or physically capable • Modify or stop activities due to weather, river conditions, or safety concerns • Remove any participant whose behaviour is considered unsafe or disruptive No refund will be issued if a participant is removed due to safety concerns or failure to follow instructions.

 

8. MINIMUM NUMBERS Some courses and activities require minimum participant numbers to operate. If minimum numbers are not reached, Fluid Flow reserves the right to: • Reschedule the activity • Offer an alternative activity • Offer participation in another session Participants will be notified as early as possible if this situation arises. 

 

9. LATE ARRIVAL Participants must arrive on time for scheduled activities. All activities begin with a mandatory safety briefing. Participants who arrive late and miss the briefing may not be permitted to join the activity. In such cases, participation cannot be guaranteed and no refund will be issued.

 

10. EQUIPMENT REQUIREMENTS For kayak skills training sessions, participants must provide their own equipment that meets Canoeing Ireland minimum safety standards. Equipment must be: • Well maintained • Fit for purpose • Suitable for the intended river or training environment For river training sessions: • River-running buoyancy aids are the minimum requirement • Rescue vests are recommended • Race or freestyle buoyancy aids are not acceptable, except during freestyle-specific sessions Fluid Flow reserves the right to refuse participation without reimbursement if equipment requirements are not met.

 

11. EQUIPMENT RESPONSIBILITY Participants are responsible for the safekeeping of any equipment issued during an activity. With the exception of normal wear and tear, Fluid Flow reserves the right to charge for equipment that is lost, damaged, or misused.

 

12. LIABILITY Bookings are accepted on the basis that Fluid Flow, its owners, and instructors accept no responsibility for injury, damage, or loss to a participant’s property or person however caused, except where required by law. Participants take part in activities at their own risk.

 

13. PARTICIPANTS UNDER 18 Participants under the age of 18 years must have explicit consent from a parent or guardian before taking part in any activity. Parents or guardians must be aware of and accept the risks associated with adventure activities. For group bookings involving minors, the group organiser must ensure parental consent has been obtained.

 

14. PHOTOGRAPHY & MEDIA Photographs and video may be taken during activities for use on the Fluid Flow website and social media channels. Participants agree to the use of such media unless they explicitly notify a member of the Fluid Flow team that they do not wish to appear in photographs or media.

 

15. PRODUCT CARE & WARRANTIES Fluid Flow works directly with product manufacturers in the event of warranty claims. New boats, boards, and equipment include a standard 1-year manufacturer’s warranty from the date of purchase. Proof of purchase is required. Used boats and equipment do not carry a warranty and are sold as seen. The buyer is responsible for ensuring satisfaction with the product before purchase. The warranty covers defects in materials or workmanship only and does not cover breakage caused through use. Warranty issues must be reported to Fluid Flow within one week of occurrence. Customers may be required to return the product for inspection. The cost of returning the product is the customer’s responsibility. If a valid claim is confirmed, Fluid Flow will repair or replace the product. If this cannot be completed within a reasonable timeframe, a full refund may be issued upon return of the product. Your statutory rights are not affected. 

 

16. RETURNS & REFUNDS (RETAIL PRODUCTS) Undamaged products may be returned within 14 days of receipt, along with original packaging and proof of purchase. Refunds will be issued via the original payment method. Products can only be returned in the country in which they were purchased. Certain products may not be eligible for return.

 

17. PAYMENT METHODS Accepted payment methods include: • Credit / Debit Cards • SumUp • Revolut Transfer • Offline Payments (where agreed) 

 

18. DATA PROTECTION & PRIVACY Fluid Flow is registered in Ireland and complies with the General Data Protection Regulation (GDPR). We collect only the personal information necessary to: • Process orders • Manage bookings • Respond to enquiries • Deliver our services Information may include: • Name • Email address • Phone number • Address or Eircode • Purchase and booking history Our website is operated through Wix, and card payments may be processed using SumUp. We do not collect unnecessary personal data and do not share personal information except where required to deliver our services.

 

19. STATUTORY RIGHTS Nothing within these Terms & Conditions affects your statutory rights under Irish or EU consumer law.
